Sketchy Turn At Busy Intersection Leads To DWI For Westchester Driver, Police Say

A 26-year-old man was busted by police in Westchester driving with a blood alcohol content more than double the legal limit after he made a questionable turn at a busy intersection near the Bronx River Parkway.

An officer from the Scarsdale Police Department on patrol on Post Road spotted a blue Toyota Camry traveling through the intersection of Post Road and Fenimore Road shortly before 6 a.m. on Sunday, April 7.

The officer said the motorist completely drove past Fenimore Road before stopping on Post Road, backing up and making a right hand turn onto Fenimore Road. A traffic stop was conducted on Fenimore Road near the entrance to the Bronx River Parkway.

While speaking with the driver, Mykhailo Tserkovnyuk of Yonkers, the officer said that he stated he was coming from White Plains and did not understand why he had been pulled over. While speaking with Tserkovnyuk, the officer detectives the odor of alcohol coming from his breath.

Tserkovnyuk proceeded to fail multiple Standardized Field Sobriety Tests and a breathalyzer found that his blood alcohol content was at .16 percent, double the legal limit. Tserkovnyuk was arrested, and found to be in possession of an undisclosed controlled substance. At Scarsdale Police Headquarters, it was determined that Tserkovnyuk’s blood alcohol content was .19 percent.

Following his arrest, Tserkovnyuk was charged with driving while intoxicated, aggravated DWI with a blood alcohol content greater than .18 and criminal possession of a controlled substance, all misdemeanors. He was also cited for unsafely backing up his vehicle, failure to use his designated lane and failure to use a turn signal.

Tserkovnyuk was arraigned and released on his own recognizance. He is scheduled to appear in Scarsdale Village Court on Wednesday, April 10 to respond to the charges.
